Terms and Conditions of the Certiget Service

In Brief

Certiget is an independent platform that supports organisations in selecting certification bodies, comparing certification quotations and obtaining information about the certification market.

Through certiget.pl and certiget.eu, users can access a directory of certification bodies, publish reviews and use services related to obtaining certification quotations and other services supporting organisations in the field of management systems.

These Terms and Conditions set out the rules governing the use of the Service and the services provided by Certiget.

1. Who We Are

The Certiget Service, available at www.certiget.pl and www.certiget.eu, is operated by Certiget sp. z o.o., with its registered office in Warsaw (02-972), Poland, at ul. Sarmacka 20A/14, entered in the Register of Entrepreneurs of the National Court Register under KRS number 0001060298, VAT ID (NIP) 9512578741, hereinafter referred to as “Certiget”.

These Terms and Conditions govern the use of the Service and the services provided by Certiget through the websites certiget.pl and certiget.eu.

 

2. What Is Certiget?

Certiget is an independent information and comparison platform supporting organisations in the selection of certification bodies and services related to management systems.

Certiget is not a certification body, does not perform certification activities and does not issue certificates of conformity with standards, management systems or other certification requirements.

The primary purpose of Certiget is to increase transparency in the certification market by providing information about certification bodies, enabling users to compare quotations and supporting informed certification-related decisions.

Through the Service, users may in particular:

a) access the certification body directory,

b) review information regarding certification bodies, their accreditations, areas of activity and services offered,

c) publish and view reviews concerning cooperation with certification bodies,

d) use services related to obtaining and comparing certification quotations,

e) use information, training, consulting and implementation services offered by Certiget or its partners.

Certiget exercises reasonable care to ensure the accuracy of the information presented within the Service. However, information published through the Service is provided for informational purposes only and does not constitute an offer within the meaning of applicable law, a guarantee of certification, or a recommendation of any specific certification body.

The selection of a certification body, entering into cooperation with any organisation, and all business decisions made on the basis of information available through the Service remain solely the responsibility of the user.

 

3. How the Service Works

Use of the Certiget Service is voluntary and free of charge with respect to publicly available functionalities.

Through the Service, users may in particular:

a) browse the certification body directory,

b) search for certification bodies by standard, location or other available criteria,

c) review information regarding certification bodies, their accreditations, areas of activity and services offered,

d) publish reviews relating to cooperation with certification bodies,

e) use contact forms and quotation request forms,

f) use additional services offered by Certiget.

Certain services available through the Service may require the provision of specific information or the conclusion of a separate agreement between the user and Certiget.

By using the Service, the user agrees to:

a) use the Service in compliance with applicable laws,

b) provide accurate and up-to-date information,

c) refrain from publishing unlawful, offensive, misleading or rights-infringing content,

d) refrain from using the Service in any manner that may disrupt its operation or compromise the security of information systems.

Certiget may develop, modify or discontinue specific functionalities of the Service where justified by technical, organisational, business or legal reasons.

Access to and use of the certification body directory does not require the use of any additional services offered by Certiget.

 

4. Obtaining Certification Quotations

Certiget enables users to use a service designed to obtain, compare and analyse certification quotations submitted by certification bodies.

The purpose of this service is to assist organisations in selecting the certification body that best meets their needs, requirements and business objectives.

In order to provide the service, users may be asked to provide information relating to their organisation, planned or existing certifications, and other information necessary for certification bodies to prepare quotations.

The information provided may be shared with certification bodies solely to the extent necessary for:

a) preparing a certification quotation,

b) assessing the feasibility of providing certification services,

c) conducting the certification process,

d) contacting the user regarding the quotation provided.

As part of delivering the service, Certiget may:

a) identify certification bodies that match the user's requirements,

b) submit quotation requests to certification bodies,

c) obtain and compile quotations,

d) assist the user in analysing quotations,

e) conduct discussions or negotiations regarding the terms of cooperation with certification bodies.

Where formal authorisation is required, Certiget may act on the basis of a separate authorisation, power of attorney or other document granted by the user.

Unless otherwise agreed in a separate contract, Certiget is not a party to any agreement concluded between the user and a certification body.

Certiget does not guarantee:

a) that quotations will be obtained from any specific number of certification bodies,

b) that the user will select a particular certification body,

c) that certification will be granted,

d) the prices quoted by certification bodies,

e) that an agreement will be concluded between the user and a certification body.

The decision to select a certification body and enter into an agreement remains solely the responsibility of the user.

The financial terms of the quotation acquisition service, including any fees, commissions or settlement arrangements, shall be specified in a separate offer, agreement or other document provided to the user before the commencement of the service.

 

5. User Reviews

Certiget enables users to publish reviews relating to their cooperation with certification bodies presented within the Service.

The purpose of publishing reviews is to support transparency in the certification market and to enable users to share their experiences of working with certification bodies.

By submitting a review, the user represents and warrants that:

a) the review is based on their genuine experience,

b) the information provided is accurate to the best of their knowledge,

c) the review does not violate applicable laws or the rights of any third party.

Reviews must not contain, in particular:

a) unlawful content,

b) offensive, defamatory or reputation-damaging content,

c) personal data relating to third parties without an appropriate legal basis,

d) advertising, promotional or spam content,

e) content unrelated to the certification body being reviewed.

The author of the review bears full responsibility for its content.

Certiget is not the author of user reviews and is not responsible for their substantive content, subject to obligations arising under applicable law.

Review Verification and Moderation

Certiget may review submitted opinions to verify their compliance with these Terms and Conditions and applicable laws.

Verification may include, in particular:

a) assessing the authenticity of the review,

b) contacting the author of the review,

c) requesting additional information reasonably necessary to confirm that the reviewer has used the services of the certification body concerned.

Certiget reserves the right to refuse publication, remove or restrict the visibility of a review where:

a) it violates these Terms and Conditions,

b) it violates applicable laws,

c) there are reasonable grounds to question its authenticity,

d) it contains misleading information or content that may cause harm to users or third parties.

Responses from Certification Bodies

Certification bodies may publish responses to reviews relating to their services.

Such responses represent solely the position of the certification body concerned and do not affect the content or rating assigned by the user.

Reporting Reviews

Any individual or organisation that believes a published review violates applicable laws, their rights or these Terms and Conditions may request that the review be reviewed by contacting Certiget.

Upon receiving such a request, Certiget will assess the matter and take appropriate action based on the circumstances and applicable legal requirements.

 

6. Personal Data Protection

Certiget processes personal data in accordance with applicable laws, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council (the General Data Protection Regulation – GDPR) and other applicable data protection legislation.

The scope, purposes, legal bases and principles governing the processing of personal data depend on the way in which the Service and the services provided by Certiget are used.

Detailed information regarding the processing of personal data, data retention periods, recipients of personal data, users' rights and the use of cookies is set out in the Privacy Policy available through the Service.

Use of the Service confirms that the user has been informed of the Privacy Policy. However, it does not constitute consent to the processing of personal data where applicable laws require separate consent.

Certiget implements appropriate technical and organisational measures designed to protect personal data and information assets against unauthorised access, loss, destruction, alteration or disclosure.

Where users utilise services relating to obtaining certification quotations or other services requiring cooperation with third parties, necessary information may be shared with relevant organisations solely to the extent required to provide the requested service.

Once personal data has been shared with an external organisation, that organisation may become an independent controller of the personal data and shall be responsible for its further processing in accordance with its own policies and applicable laws.

 

7. Complaints

If a user believes that the Service is not functioning properly or that services provided directly by Certiget have not been delivered as agreed, the user may submit a complaint.

Complaints may be submitted:

a) by e-mail to: [email protected],

b) via the contact form available through the Service,

c) in writing to Certiget's registered office address.

To facilitate the efficient handling of a complaint, the submission should include:

a) information enabling the identification of the user,

b) a description of the issue or concern,

c) an indication of the service or functionality to which the complaint relates.

If the information provided in the complaint is insufficient to assess the matter, Certiget may request additional information from the user.

Certiget will review the complaint without undue delay and, in any event, no later than 14 days from the date of receipt of the complaint or from the date on which all information necessary to assess the complaint has been received.

Information regarding the outcome of the complaint will be communicated using the contact details provided by the user.

This complaints procedure applies exclusively to services provided directly by Certiget.

Complaints relating to services provided by certification bodies, training providers, consultants or other organisations cooperating directly with the user should be submitted directly to the relevant organisation.

The use of this complaints procedure does not limit or exclude any rights granted to users under applicable law.

 

8. Liability

Certiget exercises reasonable care to ensure that the information published through the Service is accurate, up to date and useful to users.

The information presented through the Service is provided for informational, educational and comparison purposes. Unless expressly stated otherwise, it does not constitute an offer within the meaning of applicable law, a guarantee of certification, or a recommendation of any particular organisation.

Certiget is not a certification body and is not responsible for:

a) decisions made by certification bodies,

b) the conduct of certification audits,

c) the issuance, suspension, restriction or withdrawal of a certificate,

d) the quality of services provided by certification bodies or other organisations cooperating with the user.

Certiget shall not be liable for content published by users, certification bodies or other third parties, including reviews, business descriptions, quotations, or materials published with their consent or on their behalf.

Certiget shall not be liable for the consequences of business decisions made by users on the basis of information available through the Service.

Certiget shall not be responsible for any temporary unavailability of the Service resulting from:

a) technical failures,

b) maintenance, development or upgrade works,

c) force majeure events,

d) actions or omissions of third parties beyond Certiget's reasonable control.

Users are solely responsible for content published or submitted through the Service and for ensuring that such content complies with applicable laws.

To the fullest extent permitted by applicable law, Certiget shall not be liable for indirect damages, consequential losses or loss of profits, unless mandatory provisions of law provide otherwise.

Nothing in these Terms and Conditions excludes or limits Certiget's liability where such exclusion or limitation would be unlawful under applicable law.

 

9. Final Provisions

These Terms and Conditions are made available free of charge through the Service in a form that allows users to access, download, save and reproduce them.

Certiget may amend these Terms and Conditions in the event of:

a) changes in applicable laws or regulations,

b) development of, or changes to, the functionalities of the Service,

c) changes to the scope of services provided,

d) organisational, technical or business changes requiring an update of these Terms and Conditions.

The current version of these Terms and Conditions is always available through the Service.

Any amendments to these Terms and Conditions shall take effect upon publication through the Service, unless a different effective date is specified.

The use of the Service and services provided by Certiget shall be governed by Polish law, subject to any mandatory provisions of law applicable to the user.

In the event of any dispute arising from the use of the Service, the parties shall first seek to resolve the matter amicably.

Where these Terms and Conditions are made available in more than one language version, the Polish language version shall prevail in the event of any inconsistency or discrepancy in interpretation.

Matters not governed by these Terms and Conditions shall be subject to applicable laws, including in particular the Polish Civil Code, the Act on the Provision of Electronic Services, the Electronic Communications Law, and Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).
